As we enter 2025, now is the perfect time to update your Will. National “Update Your Will Week” reminds you to review and revise it. Whether you’ve had major life changes or haven’t revisited your Will in years, updating it ensures your wishes are clearly documented.
Why You Should Update Your Will
Your Will is a key legal document that ensures your assets are distributed according to your wishes. However, life is always changing, and your circumstances may shift over time. Here are several important reasons why updating your Will is crucial:
Life Changes: Significant events such as marriage, divorce, the birth of children, or the death of a loved one may require updates to your Will.
Changes in Assets: If you’ve gained new assets, such as property, investments, or valuable items, it’s essential to include them in your Will.
Beneficiary Changes: If your relationships with beneficiaries change, or if a beneficiary passes away, you should update their details in your Will.
Tax Planning: As tax laws and your financial situation evolve, reviewing your Will ensures it aligns with current tax regulations.
What to Review in Your Will
When updating your Will, consider reviewing these key areas:
Beneficiaries: Double-check that all your beneficiaries are accurately named, and their share of the estate is clearly specified.
Executor: Your executor should be someone you trust to handle your estate, ensuring they are capable of managing the process.
Guardianship for Children: If you have young children, designate a trusted guardian to care for them in the event of your death.
Special Assets: If you own a business or valuable items (such as jewellery or artwork), make sure these are properly included in your Will.
The Benefits of Keeping Your Will Updated
Peace of Mind: Regularly updating your Will gives you confidence that your wishes will be followed without confusion or disputes.
Protection for Loved Ones: An up-to-date Will helps your family avoid unnecessary stress and legal challenges during a difficult time.
Avoiding Intestacy: If you die without a valid Will, your estate will be distributed according to the laws of intestacy, which may not align with your wishes. Updating your Will ensures your estate is handled as you desire.
How Often Should You Update Your Will?
While there’s no fixed rule for how often to update a Will, it’s generally recommended to review it every 3-5 years or after any significant life event. You should consider updating your Will if:
You get married or divorced
You have a child or adopt one
You acquire or sell significant assets, like property
You move to a different jurisdiction with different inheritance laws
Why Seek Professional Legal Advice?
Although updating your Will may seem simple, it’s always advisable to consult a solicitor. A legal professional can help ensure that your Will is valid and properly executed. This is particularly important if you have a large or complicated estate, as a solicitor can guide you through any complexities and ensure your Will reflects your wishes accurately.
